TERMS AND CONDITIONS OF USE
Yiriba Residence Booking Platform
Version effective as of: April 9, 2026
Please read these Terms and Conditions carefully before using our platform.

1. Introduction and Acceptance
By accessing or using the Yiriba Residence website, mobile application, or any other service (hereinafter "the Platform"), you agree to be bound by these Terms and Conditions of Use ("Terms").

If you do not agree to these Terms, you must not use the Platform.

The Platform is operated by Yiriba Residence SARL (or the designated company), a company incorporated under Burkinabe law, with its registered office in Ouagadougou, Burkina Faso (hereinafter "We," "Us," or "Yiriba Residence").

2. Definitions
- User/Client: Any natural or legal person who consults or books via the Platform.
- Hotel/Residence: The Yiriba Residence is located in Burkina Faso.

- Booking: Room or service request confirmed via the Platform.

- Content: Texts, photos, reviews, etc., published on the Platform.

3. Services Offered
The Platform allows you to:
- View room availability, rates, and descriptions;

- Make online reservations;

- Manage your reservations (modification, cancellation subject to conditions);
- Leave reviews after your stay.

We act as an intermediary between you and the Yiriba Residence Hotel.

4. Account Creation
To make a reservation, you must create an account with accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your password and for all activities carried out under your account.

You must be at least 18 years old or accompanied by a responsible adult.

5. Booking Process and Contract Formation
- All bookings are subject to the hotel's actual availability at the time of confirmation.

- The booking contract is concluded directly between you and Résidence Yiriba upon receipt of the confirmation email or SMS.

- We reserve the right to refuse or cancel a booking in the event of fraud, pricing errors, suspected illegal use, or exceeding quotas.

6. Rates and Payment
- Prices are displayed in CFA Francs (XOF) and include VAT applicable in Burkina Faso, unless otherwise stated.

- Payment can be made by credit card, mobile money (Orange Money, Moov Money, etc.), or any other available method.

- The booking is confirmed after receipt or pre-authorization of the amount.

- Any tourist tax or additional charges (breakfast, etc.) will be specified at the time of booking.

7. Cancellation, Modification, and Refund
Cancellation conditions depend on the chosen rate:

- In the event of force majeure (epidemic, natural disaster, government decision), we will explore appropriate solutions (postponement or refund, depending on availability).

- Any modification is subject to availability and may incur an additional charge.

8. User Obligations
You agree to:

- Use the Platform lawfully and honestly;

- Provide truthful information;

- Comply with the Hotel's internal regulations during your stay;

- Not publish any illegal, defamatory, pornographic, or hate-inciting content.

9. Liability
Yiriba Residence is not liable for:

- Direct or indirect damages resulting from the use of the Platform (data loss, viruses, etc.);

- Acts or omissions of the Hotel (quality of service, security, etc.);

- Temporary interruptions of the Platform for maintenance.

We disclaim all liability in the event of overbooking, administrative closure, or events beyond our control.

10. Intellectual Property
All elements of the Platform (logo, design, photos, texts) are the exclusive property of Résidence Yiriba or its partners and are protected by Burkinabe and international intellectual property law. Any reproduction without authorization is prohibited.

11. Protection of Personal Data
We process your data in accordance with the regulations in force in Burkina Faso (Law No. 015-2013/AN on the protection of personal data).
You have the right to access, rectify, object to, and delete your data by contacting us at the address indicated below.

12. User Reviews and Content
Published reviews reflect the opinions of our customers. We reserve the right to moderate or remove any content that violates these Terms.

13. Modification of Terms
We may modify these Terms at any time. The updated version will be posted on the Platform with the new effective date. Your continued use of the Platform constitutes acceptance of the new Terms.

14. Applicable Law and Dispute Resolution

These Terms and Conditions are governed by Burkinabe law.

Any dispute will be subject to the exclusive jurisdiction of the courts of Ouagadougou, Burkina Faso.

Before resorting to legal action, we will seek an amicable solution.
